Payments survey terms and conditions (April 2024)
- For the purposes of these Terms and Conditions, “The Promoter” refers to eVision Pty Ltd (aka MessageXchange) and Colladium Australia Pty Ltd. The “Prize” refers to a $100 electronic gift voucher (selected by you from a range of well-known consumer goods merchants that will be notified to you in the invite).
- By entering the competition you agree to be bound by these terms and conditions. All entries must be received by 5pm AEST on Wednesday that 24th of April 2024. Ten (10) winners in Australia will be selected at random by The Promoter on Friday the 26th of April in Melbourne, and the winner will be notified by email on or promptly (and within 5 business days) after this date.
- The Promotor’s competitions are open only . The invitation will specify when the competitions starts.
- Entrants must complete the survey linked to the invitation, to enter the competition. The survey feedback will be used by The Promoter to evaluate the services The Promoter adds onto its MessageXchange and/or Colladium platforms. The Promoter will only use any personal information provided as a result of entry into the competition for this purpose and for the purpose of running the competition and awarding the Prize (if the entrant is a winner), including (a) announcing the winner on The Promotor’s website or social media channels and (b) providing the winner’s details to the merchant supplying the e-voucher (for the issue of that voucher).
- The Promoter reserves the right to disqualify any entrant’s entry if it infringes a third party’s rights (including confidentiality, privacy or IP rights), is in The Promoter’s reasonable view, objectionable, inflammatory or defamatory. Entries that are incomplete or illegible will be invalid.
- No purchase is necessary. Winners will not be required to pay to enter the competition.
- Entrants must be over 18 years old on the date of their entry and also an existing customer of MessageXchange or Colladium.
- The Promoter’s employees and contractors (and their immediate families) are not eligible to enter.
- Only one entry per person/organisation per competition will be accepted.
- Entrants can only enter the competition via the link provided on the invitation.
- The Prize will be awarded to randomly selected entrants, using a random number generator.
- The Promoter will not be held liable if, for reasons beyond The Promoter’s reasonable control:
- the named prize becomes unavailable or cannot be fulfilled.
- entries are not received by The Promoter;
- entries are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.
- To the extent permitted by law:
- The Promoter’s liability is limited to the cost price of the Prize in question; and
- The Promoter is not liable for any indirect, special or consequential loss suffered by any entrant
in connection with the competition.
- Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, The Promoter reserves the right to substitute that prize for a prize of equal or higher value.
- The name, address, email address and phone number of the winner must be provided to The Promoter if requested, to enable fulfilment of the Prize (including sharing the winner’s details with the relevant merchant so that those details can be entered on the e-voucher selected by the winner).
- In the event of unforeseen circumstances beyond The Promoter’s reasonable control, The Promoter reserves the right to cancel, modify or suspend the competition, either in whole or in part, by providing written notice to entrants.
- The Promoter’s decision is final. No correspondence will be entered into.
